Terms and Conditions of Bonny Maids for Customers

 

1. Please read these Terms carefully. As part of the process you will be required to show that you have read and understood these Terms by signing this document. If you do not accept these Terms, you should not sign this document.

 2. Definitions

 

2.1. We are Bonny Maids and we operate as an Agency. Our address is: Bonny Maids LTD, 86-90 Paul Street, London, EC2A 4NE

2.2. References to we, our, us in these Terms shall mean Bonny Maids

2.3. Reference to the Cleaner shall mean the person seeking to or providing

       Cleaning Services

2.4. References to the Client shall mean the person seeking Cleaning

       Services

2.5. Cleaning Services shall mean the specific services agreed between the

        Client and the Cleaner and shall consist of the cleaning of domestic 

        premises, and other associated cleaning services.

 

  1. Relationships Between Parties

 

  1.      Bonny Maids is a recruitment agency meaning we introduce suitable self employed Cleaners to Clients that require domestic cleaning services.

  2. Nothing contained in these Terms shall create a relationship of employer and employee or partnership between Cleaner and us and nothing contained in these Terms shall create a relationship of employer and employee between Client and Cleaner.

 

  1. Any agreement between a Client and a Cleaner for the Cleaner to perform Cleaning Services and the Client to pay the Cleaner takes the form of a contract between those two parties and we are not a party to that contract.

  2. Payment is made by the Client to the Cleaner directly. All details of how often and by what payment method is agreed between the Client and Cleaner and we take no part in this. If the Client fails to make payment as agreed to the cleaner, this is a dispute between the Client and Cleaner and we are not liable and do not enter into a dispute.

  3. Cleaners are vetted by a telephone interview; obtaining proof of address document/s, contacting references and having themselves and their photo ID digitally verified using a third party identification verification company called Veriff. In a small amount of cases, ID is verified manually by Bonny Maids if there are technical issues. DBS checks are provided only by specific request from the client which may incur an additional one off cost.

 

 

  1. Agreement

 

  1. By agreeing to these Terms, the Client:

4.1 (1). understands and accept these Terms;

4.1 (2). are resident in the United Kingdom;

  1.  (3). are legally capable of entering into binding contracts

4.1 (4). are at least 18 years old.

4.2. The Client agrees to:

  1. (1). provide true, accurate, current and complete information about their self; and

  2. (2). maintain and promptly update their details with us to keep it true, accurate, current and complete.

 

  1. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect the same, or if you commit any breach of these Terms or do anything that we, in our absolute discretion, believe may damage our reputation, we have the right to terminate this agreement.

 

  1. Use of Data of the Client

 

5.1. Clients agree that their contact details may be shared with Cleaners who are looking to provide their Cleaning Services, are on the database of Bonny Maids, and have been suitably vetted.

5.2. We will not, except as set out in these Terms, disclose confidential or sensitive information about you to any third parties without your consent except where obliged to do so by UK law.

 

  1. Agency Obligations.

Bonny Maids will use reasonable skill to provide a Cleaner for the amount of hours and frequency as described at the beginning of these Terms to the Client described at the beginning of these Terms.

 

  1. Fees and Payments

7.1. The hourly agency fee you agree to pay is £4.95 GBP. Approximately 0.15p of every hour paid for the management cost (£4.95) will be donated to Cancer Research UK via Work for Good.

7.2. The Client must pay agency fees 1 month in advance for the contracted amount of hours described at the beginning of these Terms.

7.3. A direct debit mandate must be in place before Cleaning Services will commence.

7.4. If the Client fails to make payment in full or the direct debit or is cancelled before all due payments are made then a £25.00 administration charge will be charged in addition to all fees that are due. This is to cover administration charges. A reduction of this administration charge may be reduced at the discretion of Bonny Maids.

7.5. Payments of agency fees will continue until this Agreement is terminated as per the Cancellation Terms of this Agreement.

7.6. If the Client and Cleaner amend the amount of hours that the Cleaner will provide their services, the Client must inform Bonny Maids of the changes as soon as possible. Bonny Maids will amend the direct debit and notify the Client of the changes to the direct debit  with the amended amount of hours that the Cleaner is providing their services for.

7.7. If the Client does not notify Bonny Maids of an increase in hours for the Cleaner providing their services, Bonny Maids reserve the right to charge additional fees. The fees will be £4.95 GBP per hour for the extra hours that the cleaner has provided their services to the Client for and that Bonny Maids were not notified of.

7.8. If the Client does not make payment for the additional fees as outlined in Clause 7.7 within 30 days then Bonny Maids reserve the right to charge an additional 5% of the total outstanding agency fees.

7.9. If the Client does not make payment for the additional fees as outlined in Clause 7.7 Bonny Maids reserve the right to terminate this Agreement with immediate effect.

 

8. Client Obligations and Agreements

8.1. The Client must do everything within reason to ensure a safe working environment at all times for the Cleaner.

8.1. Bonny Maids will introduce a self employed Cleaner to the Client. The Client agrees to retain the Cleaner under a Contract for Services between the Cleaner and the Client. This can be a verbal or written agreement between these two parties.

8.2. The Client agrees to notify Bonny Maids as soon as is reasonably possible if the Cleaner does not attend to carry out their services at the agreed time or completely stops providing their services to the Client. This is so that Bonny Maids can find a replacement Cleaner for the Client.

8.3. If the Client fails to notify Bonny Maids of a situation as outlined in Clause 8.2, Bonny Maids reserve the right not to refund any agency fees during the periods the Cleaner has not attended but may still do so at our discretion.

8.4. The Client must provide all products and equipment for the Cleaner to carry out their services. Bonny Maids reserve the right not to refund agency fees if the Client has failed to provide the necessary equipment which results in either the service not taking place or only partly completed. Any refund of fees will be at Bonny Maids discretion.

8.5. Clients must not request the Cleaners to use any equipment that may be unsafe or need specialist training to operate.

8.6. Clients must not ask the Cleaners to work at height or use anything to climb.

9. Insurance

9.1. Bonny Maids have £1 000 000 GBP insurance cover in place which covers accidental damages made by a Cleaner introduced by Bonny Maids to the Client. The policy also covers loss or damage to keys up to £50 000.

9.2. The insurance policy excess if £500 GBP for accidental damages and damage or loss of keys (separately). Bonny Maids and our Insurers will not be liable for the first £500 GBP of any claim made under that policy to Bonny Maids or our insurers. This shall be payable by the Client. We advise the Client to have their own insurance policy in place to cover damages under this amount of £500 GBP.

9.3. Clients will not be covered by our insurance cover if the Cleaner was not introduced directly from Bonny Maids to the Client or if these Terms have been breached by the Client.

9.4. Clients must inform Bonny Maids of any damages within 24 hours of the Cleaning Services taking place or as soon as is reasonably possible.

10. Liabilities

10.1. Bonny Maids accepts no responsibility for any losses as a result of the Cleaner not complying with their obligations.

10.2. Bonny Maids will not be liable for any loss or damage that falls outside the scope of their insurance policy or is in excess of £1 000 000 except in the case of death or personal injury caused by Bonny Maids negligence.

10.3. The statutory rights the Client may have as a consumer are not affected by anything in these Terms.

10.4. You acknowledge that where you agree to a Cleaner introduced to you to perform Cleaning Services, this is an agreement between you and the Cleaner and we shall not be a party to that agreement or have any liability in relation to it.

10.5. You shall not involve us in any proceedings or other dispute between you and any Cleaner. You agree to indemnify us and hold us harmless in respect of any loss, damage or costs you incur as a result of becoming involved in any dispute between you and a Cleaner.

10.6. We shall not be liable for:

10.6. (1). loss of income or revenue;

10.6. (2). loss of business;

10.6. (3). loss of profits or contracts;

10.6. (4). loss of anticipated savings;

10.6. (5). loss of data; or

10.6. (6). waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.

10.7. Nothing in these Terms shall limit in any way our liability for:

10.7. (1). death or personal injury caused by our negligence;

10.7. (2). fraud or fraudulent misrepresentation; or

10.7. (3). other matter for which it would be illegal for us to limit or exclude, or attempt to limit or exclude, our liability.

11. Termination

11.1. The Client or Bonny Maids may terminate this Agreement notice in writing to the other party. The Client can cancel services with Bonny Maids with immediate effect at any point, no notice is required.

12. Non – Solicitation

 

12.1. The Client agrees not to engage a Cleaner introduced by Bonny Maids to the Client in any cleaning or closely related tasks within 12 months after receiving the contact details of or meeting a Cleaner or last being provided with cleaning services from that Cleaner. This will be shared jointly with the Cleaner

12.2. If you break this clause, you agree to pay Bonny Maids the equivalent to 12 months in agency fees based on the number of contractual hours that the Client has signed the Agreement for. 

13. Transfer of Rights and Obligations

13.1. The contract between you and us is binding on you and us and on our respective successors and assignees.  A Cleaner may arrange for a third party to carry out Cleaning Services which the Cleaner has agreed to provide if the Cleaner is unable or unwilling to carry out the Cleaning Service personally.

 

14. Severability 

14.1. If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

15. Entire Agreement 

15.1. These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us.

15.2. We each acknowledge that, in entering into these Terms, neither of us relies on any statement, representation, assurance or warranty (Representation) of any person (whether a party to these Terms or not) other than as expressly set out in these Terms.

15.3. Each of us agrees that the only rights and remedies available to us arising out of or in connection with a Representation shall be for breach of contract as provided in these Terms.

16. Law and Jurisdiction

16.1. This contract and any associated non-contractual disputes or claims, are governed by English law and are subject to the jurisdiction of the English courts.

17. Bonny Maids Privacy Policy

17.1. By signing this agreement, you are confirming you have read and agree with our Privacy Policy which can be found here: https://www.bonnymaids.co.uk/privacy-policy. When you use our services, you may provide us with personal information about you such as your name, address, telephone numbers and email address (Personal Information). We will only use your Personal Information in accordance with the Data Protection Act 2018 and UK GDPR and any other relevant laws and regulations.

17.2. You are entitled by law to ask for a copy of your Personal Information at any time by writing to us at the postal or email address set out in clause 1. You are entitled to ask us to correct or update your Personal Information at any time by contacting us at the address Bonny Maids LTD, 86-90 Paul Street, London, EC2A 4NE

17.3. We may use your Personal Information for the purposes of carrying out our obligations under these Terms;

17.4 (1). maintaining your registration with us;

17.4 (2). providing you with information, assignments or services that you request from us or which we feel may interest you, where you have consented to be contacted for such a purpose;

17.4. (3). notifying you about a change to our services; and

  1. (4). record-keeping

17.5. You consent to us (and our representatives) disclosing your Personal Information to third parties:

17.5 (1). in the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets;

  1. (2). if we are under a duty to disclose or share your Personal Information in order to comply with any legal obligation, or in order to enforce or apply such other terms as apply to our relationship, or to protect the rights, property, or safety of our customers, ourselves or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction; and

  2. (3). if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Website.

If you consent to receiving marketing communications and referral offers from Bonny Maids regarding our products and services, as well as those offered by other businesses under our corporate group, these may include emails, phone and sms. you can opt out at any time by clicking ‘unsubscribe’ in our emails or contacting us at info@bonnymaids.co.uk

  1. These Terms and Conditions (Terms) govern your relationship with Bonny Maids when you apply to be added to our database to provide Cleaning Services.

2.5. References to the householder shall mean the person seeking Cleaning

       Services

2.6. Cleaning Services shall mean the specific services agreed between the

        householder and the Cleaner and shall consist of the cleaning of domestic  

        premises, and other associated cleaning or ironing services.

 

  1. Relationships Between Parties

 

  1. Any agreement between a householder and a Cleaner for the Cleaner to perform Cleaning Services and the householder to pay the Cleaner takes the form of a contract between those two parties and we are not a party to that contract.

  2. Payment is made by the customer to the Cleaner directly. All details of how often and by what payment method is agreed between the customer and Cleaner and we take no part in this. If the customer fails to make payment as agreed to the cleaner, this is a dispute between the customer and Cleaner and we are not liable and do not enter into a dispute.

  3. Nothing contained in these Terms shall create a relationship of employer and employee or partnership between Cleaner and us and nothing contained in these Terms shall create a relationship of employer and employee between householder and Cleaner.

  4. Bonny Maids is not obliged to offer work to the Cleaner and the Cleaner is not obliged to accept any work or make their services available at any time. Bonny Maids and the Cleaner agree that they do not intend to create or imply any mutuality of obligations at any time.

  5. The Cleaner can provide any services to any other parties at the same time as providing services to Clients of Bonny Maids. Bonny Maids will not have priority of use of the Cleaner’s services over any other party.

 

  1. Agreement

 

  1. By agreeing to these Terms, the Cleaner:

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect the same, or if you commit any breach of these Terms or do anything that we, in our absolute discretion, believe may damage our reputation, we have the right remove you from our database.

 

  1. Use of Data of Cleaner

 

5.1. Cleaners agree that their contact details may be shared with householders who are looking for Cleaning Services which we consider you may be able to provide. This is to allow householders to make a decision on using our services based on this information.

5.2. We will not, except as set out in these Terms, disclose confidential or sensitive information about you to any third parties without your consent except where obliged to do so by UK law.

6. Cleaner Obligations

6.1. You will notify us of any changes to your contact details, address details or a change in your working circumstances, in writing, by email to info@bonnymaids.co.uk. This is especially important to keep us updated about your availability to provide Cleaning Services. Our phone number should you need to call is 0121 2694612.

6.2. The Cleaner is obliged to provide invoices to the customer.

6.3. The Cleaner is responsible for all of their expenses.

6.4. You will have the right to determine how the work shall be carried out but agree to give consideration to any reasonable requests from the householder in respect of the cleaning materials to be used, for example to use organic or hypo-allergenic cleaning materials or specific products on delicate surfaces. The products and equipment will in most cases be provided by the householder but you may come to an agreement with them to provide the products and equipment yourself.

6.6. You will keep information about other customer confidential.

6.7. You accept that we cannot guarantee that suitable opportunities to provide Cleaning Services will be made available for you.

6.8. You acknowledge that we do not check or verify any details submitted by customer and that we cannot guarantee that the information provided in their profiles or description of Cleaning Services required are correct.

6.9. Before signing these Terms, the Cleaner must be registered with HMRC as being self employed and agree to complete their self assessment each year, paying any tax and national insurance contributions due to the relevant authorities.

7. Performance of Cleaning Services

7.1. Once a request for Cleaning Services has been accepted by a Cleaner, the Cleaner will perform the Cleaning Services required. For the avoidance of doubt, we are not involved in the performance of the Cleaning Services or in management, direction, supervision, control or monitoring the agreed Cleaning Services, save that the customer and Cleaner arrange the time and location of the introduction meeting and ongoing cleaning using our services.

7.2. Should the cleaner not be able to gain access to the property within a reasonable time after the stated estimated arrival time, the Cleaner should have an agreement in place, verbal or written, with the customer as to what should happen in terms of still being paid or not. We have no control over the householder payments to you and your agreement with them in any circumstances.

7.3. We have no control over the quality, timing or any other aspect whatsoever relating to the Cleaning Services provided and how it is performed by the Cleaner, nor as to the integrity, responsibility or the actions or omissions of any customer.

7.4. The Cleaner has a right to send a substitute to perform their services. The customer has the right to reject the substitute if they believe they do not possess the necessary skills to perform the services. If a substitute is sent then the Cleaner bears all responsibility for the substitute and there will be no contractual relationship between the Householder and the substitute. The substitute will not be covered under our insurance policy.

8. Cleaner Safety

8.1. We do not verify the identities of any householders and we are not responsible to you should any householder give inaccurate information to you.

8.2. You are responsible for your own personal safety when meeting a householder and must take all necessary precautions when meeting someone for the first time.

8.3. You take all responsibility for contact between you and a householder, acknowledge to us that such contact is at your own risk and that we are not responsible for any such contact.

 

9. Our Liability

9.1. You acknowledge that where you agree to perform Cleaning Services or to engage a householder to perform Cleaning Services this is an agreement between you and the customer and we shall not be a party to that agreement or have any liability in relation to it.

9.2. You shall not involve us in any proceedings or other dispute between you and any customer. You agree to indemnify us and hold us harmless in respect of any loss, damage or costs you incur as a result of becoming involved in any dispute between you and a customer.

9.3. We shall not be liable for:

9.3 (1). loss of income or revenue;

9.3 (2). loss of business;

9.3 (3). loss of profits or contracts;

9.3 (4). loss of anticipated savings;

9.3 (5). loss of data; or

9.3 (6). waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.

10. Non – Solicitation

 

10.1. The Cleaner agrees not to engage in any cleaning or closely related tasks, for the customer within 12 months after receiving the contact details of a customer or last providing cleaning services to that customer.

10.2. If you break this clause, you agree to pay Bonny Maids the equivalent to 12 months in agency fees based on the number of contractual hours that the customer previously had services with us for. This will be shared jointly with the customer.

11. Transfer of Rights and Obligations

11. The contract between you and us is binding on you and us and on our respective successors and assignees. A Cleaner may arrange for a third party to carry out Cleaning Services which the Cleaner has agreed to provide if the Cleaner is unable or unwilling to carry out the Cleaning Service personally.

15.3 (2). providing you with information, assignments or services that you request from us or which we feel may interest you, where you have consented to be contacted for such a purpose; these include but are not limited to text messages and emails;

15.3 (3). notifying you about a change to our services; and

  1. (4). record-keeping

15.4. You consent to us (and our representatives) disclosing your Personal Information to third parties:

15.4 (1). in the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets;

  1. (2). if we are under a duty to disclose or share your Personal Information in order to comply with any legal obligation, or in order to enforce or apply such other terms as apply to our relationship, or to protect the rights, property, or safety of our customers, ourselves or others.
